SMS & RCS Terms of Service
These terms govern the text messages Bandmate sends to your phone — by SMS or by RCS (Rich Communication Services) — when you opt in to mobile notifications. They supplement our Terms of Service; for how your messaging data is handled, see the SMS & RCS Privacy Policy.
The messaging program
Bandmate's text messages are service messages, not advertising: account-security alerts (such as sign-in codes), and the notifications you turn on — for example, new replies to your listings, messages from other members, and gig or rehearsal reminders. We do not send third-party marketing to your phone, and we do not sell or rent your phone number.
Your consent
We only text numbers that have explicitly opted in — for example, by entering your phone number in your Bandmate account settings and confirming it, or by checking an opt-in box that is not pre-checked. By opting in, you confirm that you are the owner or authorized user of that number, that you are at least 16 years old (consistent with our Terms of Service), and that you agree to receive Bandmate texts at that number.
Consent to receive text messages is never a condition of creating an account, using Bandmate, or making a purchase.
Message frequency and cost
Message frequency varies with your activity and the notifications you enable — you control the categories in your account settings. Message and data rates may apply, depending on your mobile plan; your carrier's pricing applies to every message sent and received, including RCS messages that use mobile data. If you're unsure what your plan charges, check with your carrier before opting in.
Opting out and getting help
You can stop text messages at any time. Reply STOP to any message and we'll stop texting that number — you may receive one final message confirming the opt-out, and it may take a short time to process. You can also turn off mobile notifications, or remove your phone number, in your account settings. Opting out of texts does not close your account or affect service emails we are required to send.
Reply HELP to any message for help, or email support@bandmate.co.
Delivery and carriers
We send messages through mobile carriers and delivery partners, and delivery is not guaranteed. Carriers are not liable for delayed or undelivered messages, and neither are we — a gig reminder that arrives late is not a breach of these terms, so don't rely on a text as your only alarm clock.
RCS is available only on supported devices, carriers, and regions; when it isn't available, messages are delivered as SMS instead. Coverage and supported carriers may change over time without notice.
Changes to the program or these terms
We may modify or discontinue the messaging program, or revise these terms, as the service evolves. For material changes we email active members at least 14 days before they take effect, consistent with our Terms of Service. If you keep receiving texts after a change takes effect, that constitutes acceptance; if you don't accept a change, opt out before it takes effect.
The fine print
The messaging program is provided "as is," and the warranty disclaimers, liability cap, governing law (State of Washington), and venue provisions of our Terms of Service apply to these terms as well. Questions? Email legal@bandmate.co. We read every message and aim to reply within two business days.
